What Florida’s rules ask an ALF to keep

Count everything that could apply, and Florida’s assisted living rules ask a home to keep 101 documents. Most homes owe fewer, because 54 of them only apply when something is true of your home, a resident or somebody on staff. Here they are, sorted the way you keep them: a file for each resident, a file for each staff member, and one for the home.

This is a list, not a score. Having every document on it is not the same as passing a survey, because a surveyor also reads what’s in them and watches your home run.

Each resident’s file

30 documents

Every resident has one, and a surveyor usually picks a few and reads them against the rule. Only 7 of these apply to every resident. The other 23 depend on things like hospice care, a do not resuscitate order, or who handles the resident’s money.

The health assessment, AHCA Form 1823, is the date to watch. It’s done around admission and again every three years, and the weight record comes due every six months.

Medications that have been abandoned or have expired must be disposed of within 30 days of being determined abandoned or expired and the disposal must be documented in the resident’s record.

A nurse may take a medication order by telephone. Such order must be promptly documented in the resident’s medication observation record. The facility must obtain a written medication order from the health care provider within 10 working days.

Each staff member’s file

One for each person on staff. Of these, 7 apply to everybody, and the other 17 depend on the job, like the core training an administrator needs or the medication course for a caregiver who helps residents with theirs.

A staff file keeps changing after somebody’s first day. The TB test comes round every year and the background screening every five, and most training is due within a set time of the hire date.

Within 30 days after beginning employment, newly hired staff must submit a written statement from a health care provider documenting that the individual does not have any signs or symptoms of communicable disease. The examination performed by the health care provider must have been conducted no earlier than 6 months before submission of the statement.

The biggest of the three, and most of it is about the home as a whole. The license lives here, along with the emergency plan and its county approval. So do the insurance, the inspection reports, the menus and a stack of written policies.

Three of them hang on a wall: the license, the Resident Bill of Rights and the four complaint phone numbers. A photo of a posting only proves it was up on the day the photo was taken.

What this list can’t tell you

Some homes owe more than this. A home licensed for limited mental health, extended congregate care or limited nursing services has extra records under rules 59A-36.020 to .022, and we haven’t mapped those yet. Of Florida’s 1,171 small ALFs, 454 hold at least one of those licenses, so for them this list is short.

It also can’t say which of the conditional documents apply to you. That depends on your residents and your staff, which is what we ask about when we set a home up.

And some of what a surveyor cites has no paper at all. A0152, the building, is the third most cited tag at small homes, and its rule doesn’t ask for a single record.

Rules get amended and renumbered, as 59A-36 was in June 2025, which is why the rule’s own words, in the fold under each list, link to its current text.
